1. Acceptance of Terms

Welcome to MyLoyalPoint. By accessing or using our loyalty rewards platform, website, and mobile applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please do not use our Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

MyLoyalPoint is a loyalty rewards platform that enables:

• Customers: To earn and redeem loyalty points at participating partner merchants
• Partners: To issue loyalty points to customers and manage their loyalty programs

Points are earned based on purchases at partner locations and can be redeemed for value at any participating partner. The conversion rate is 1 point = ₦1.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Points and Rewards

Earning Points

Points are earned when you make qualifying purchases at partner merchants. The number of points earned depends on the partner's cashback rate, which may vary.

Redeeming Points

Points can be redeemed at any participating partner merchant. Minimum redemption amount is ₦1,000 worth of points. Points have no cash value and cannot be exchanged for cash.

Point Expiration

Points expire 5 years from the date they are earned. Expired points cannot be recovered or reinstated.

5. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Create multiple accounts to abuse promotions or rewards
• Engage in fraudulent transactions or misrepresent information
• Transfer, sell, or trade points or accounts
• Use automated systems or bots to interact with the Service

6. Partner Merchants

Partner merchants are independent businesses that participate in the MyLoyalPoint program. We are not responsible for:

• The quality of products or services provided by partners
• Partner pricing, availability, or business practices
• Disputes between you and partner merchants
• Partner merchant closures or program changes

7. Intellectual Property

The Service and its original content, features, and functionality are owned by MyLoyalPoint and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYLOYALPOINT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless MyLoyalPoint, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service at any time, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent or suspicious activity
• Extended period of inactivity
• Request by law enforcement or government agencies

Upon termination, your right to use the Service will cease immediately, and any accumulated points may be forfeited.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Nigeria.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
